Use of clients’ personal data

1. Conditions of use of users’ personal data
When supplying their data, users must approve the confidentiality policy and accept its terms.
The confidentiality policy may be modified or updated at any time, without prior notice, with the exception of stipulations which require users’ consent.
BE MY PORT collects and uses personal data provided voluntarily by users.
Users are required to supply personal data and information that is accurate, honest and truthful, and to update such data and information as soon as that should become necessary so that it remains full and accurate.
BE MY PORT gathers and processes users’ personal data in a fair and legal way, respecting users’ rights.
BE MY PORT is in charge of processing users’ personal data.
Under no circumstances will BE MY PORT cede or sell users’ personal data to a third party, aside from the exceptions listed below.

2. The nature of personal data gathered by BE MY PORT
The kind of personal data that may be processed is as follows: clients’ surnames, first names, postal address, email address, telephone number (discretionary) and users’ IP addresses.

3. Protection, storage and deletion of personal data
Personal data provided by users is stored by the BE MY PORT hosting service-provider.
Traffic data is generated when the user’s terminal is connected to the website.
At any time, clients may request that their account be closed. Should this happen, all personal data concerning them will be deleted.
Accounts will be closed within two (2) months of the request to close the account being submitted and, in any event, after any ongoing orders have been completed.
BE MY PORT stores clients’ personal data while their account is active and deletes it within a maximum of five years of an account being closed.

4. BE MY PORT’s communications
Where clients have agreed to this, BE MY PORT may send emails to the email address associated with their account to inform them of changes to the website or its activities, or to communicate technical or administrative information.
Under no circumstances will clients receive emails from third party companies or BE MY PORT partners unless they have agreed to this.

5. Transfer of users’ personal data
BE MY PORT may transfer users’ personal data to their service-providers such as ICODIA or Google Analytics.
BE MY PORT undertakes to refrain from communicating, ceding or transferring personal data to other third parties (excluding service-providers) without the explicit agreement of users. However, personal data may be communicated if so required by law, or upon an administrative or judicial request.

6. Users’ rights over their personal data
In accordance with legislation and regulations relating to data protection, BE MY PORT hereby informs users of their right to access, alter, oppose the processing of or request the deletion of any of their personal data that may have been gathered and processed, and to be provided with a structured and legible communication (unless there is a legitimate impediment). However, the deletion of their personal data will result in the closure of their account.
Users also have the right to lodge a complaint with a supervisory authority and control and define the directives relating to their digital legacy.

BE MY PORT cookies policy

1. Cookies
A cookie is a file that may be saved on the hard drive of a user’s terminal when browsing the website.
These small files may contain, for example, a client’s browsing history or preferences.
BE MY PORT may place cookies on users’ terminals in order to enable them to browse the website more efficiently, to save users’ profiles and restore their preferences when they connect via their usual terminal or to gather statistics.

2. The type of cookies used by the website
BE MY PORT uses the following cookies:

  • Browsing, which are cookies required to ensure the website’s correct technical functioning because they enable us to optimise the displaying of content at each user terminal;
  • Operational, which are not vital to the correct functioning of the website, but they improve the user experience of the website by enabling the website to identify the user;
  • Analytical, enabling users’ browser habits to be tracked for optimisation purposes. The information collected includes, in particular, the number of visitors, where they are from and details of the pages visited. This information enables us to add improvements to the website. BE MY PORT uses Google Analytics, an audience measuring service-provider, which gathers the following data: provenance of connection (access providers), type and version of browser used, browser language, length of connection and IP address, etc., and cookie storage on users’ terminals for the purpose of measuring audience numbers. The data generated by cookies is transmitted by Google Inc. and stored on servers located in the United States. Google Inc. uses the data for the purpose of evaluating website usage, but will not link users’ IP addresses with any other data held by Google Inc.     BE MY PORT does not store cookies enabling users to be traced or their IP addresses to be obtained for more than thirteen (13) months after they are first placed on a user’s terminal.

Users may remove cookies from their browsing software at any time, and configure the software to prevent cookies being stored on their terminal.
BE MY PORT suggests they consult the help section of their browser software to work out the right settings for them.

3. Traffic
Traffic data is generated when the user’s terminal is connected to the website.
This data may be used for statistical purposes to analyse the frequency of use of the website so as to improve it by adapting it to users’ needs.
Traffic data is never used nominatively by BE MY PORT.
